Services Provided by or for Third Parties
In the event that a User purchases a service as a result of information accessed on this Page, whether through another travel agency or any third-party intermediary, Inspira Travel Agency is released from all liability or obligation arising from the intermediary’s failure to provide the service or product. This release of liability also applies to incorrect information provided by the intermediary or third-party travel agency when reserving services, or any negligence in failing to inform the User about purchasing, payment, and cancellation conditions.
Waiver of Liability – Inspira Travel Agency as Information Source
Inspira Travel Agency operates solely as an information source in the section of the Page accessible before login to the Affiliates section and is not a direct supplier of touristic services. Therefore, it is not responsible for any part of the relationship between the User and the End Service Supplier. Inspira Travel Agency cannot be held liable for any fault or omission by a Supplier, including but not limited to failures by airlines, hotels, temporary accommodation providers, car rental agencies, transportation services, and any act or omission arising from services provided by Suppliers and not directly by Inspira Travel Agency.
As an information source, Inspira Travel Agency provides no guarantees for services directly provided by a Supplier, nor does it guarantee the financial solvency of any Supplier or any refunds that a User might claim due to losses from a Supplier’s insolvency. If a Supplier fails to provide a service already paid for by a User, the User’s recourse for a refund is solely against the Supplier who failed to provide the service. This also applies to insurance coverage or claims against any third party.
Inspira Travel Agency assumes no liability towards Users and Users release Inspira Travel Agency from any liability arising from acts or omissions, complaints, or dissatisfaction caused by services provided by a Supplier and advertised on the Page. Inspira Travel Agency has no legal relationship with Supplier employees, equipment, operations, or property. Any service-related claims must be addressed directly by the User with the Supplier.
Furthermore, the Page may contain material provided by third parties, and there may be various rating systems used for hotels and travel arrangements. Inspira Travel Agency is not liable and Users waive all claims against Inspira Travel Agency regarding:
(a) The authenticity of photographs on the Page, as they are illustrative and do not guarantee identical settings upon arrival.
(b) Star ratings of hotels and services, which are based on Inspira Travel Agency’s and the Supplier’s interpretations and may differ from other sources.
(c) Travel service descriptions, which are updated to the best of Inspira Travel Agency’s ability but are not guaranteed to be exactly the same upon arrival.
Furthermore, Inspira Travel Agency is not liable and Users release Inspira Travel Agency from all liability regarding:
(d) Travel documents, such as passports, visas, certificates, and travel authorizations for minors, which are the User’s responsibility to obtain.
(e) User’s failure to follow travel instructions, including departure times, hotel check-in/out times, and coupon exchange policies.
(f) A Supplier’s inability to provide a Service.
(g) Inspira Travel Agency assumes no liability for Supplier terms, conditions, and/or policies. It is not liable for any claim, cost, expense, or loss suffered by a User, including personal or third-party injury, accident, or death, damage to personal property, loss of enjoyment, anger, disappointment, anguish, and frustration, whether mental or physical, when caused by:
I. Fault or negligence of a Supplier.
II. Fault or negligence of a User when using the purchased service.
III. User’s failure to comply with terms and conditions, policies, instructions, safety measures, etc., provided by the End Supplier.
IV. Force majeure or unforeseen circumstances such as labor strikes, delays, earthquakes, war, hurricanes, snowfall, etc.
V. Actions or omissions of any person not under Inspira Travel Agency’s direct control.
VI. Sickness, theft, labor disputes, mechanical failures, quarantine, government actions, weather, or any other cause beyond Inspira Travel Agency’s control.
VII. Situations where a User insists on participating in any travel, touristic activity, tour, excursion, or transport while in a weak or unhealthy state, or insists on extreme sports or dangerous activities, or fails to report diseases, medical conditions, incapacities, allergies, medications, or medical orders, which are all at the User’s own risk. Users release Inspira Travel Agency from any liability for claims, lawsuits, complaints, or compensation arising from incidents during such activities.
VIII. Any other event not directly controlled by Inspira Travel Agency.
Users are responsible for verifying that Suppliers can provide necessary special services, such as access, facilities, and services for individuals with disabilities. Users are responsible for reading and complying with Supplier terms and conditions and policies, which are independent of these Terms and Conditions.
Termination Clause
Inspira Travel Agency reserves the right to terminate these Terms and Conditions and/or any services at any time without prior notice for any reason, including inappropriate use of this Page or failure to comply with these Terms and Conditions. Termination will not affect any rights or obligations of Inspira Travel Agency accrued prior to termination.
Transfer Restrictions
Users may not assign, subcontract, or transfer their rights and obligations under this agreement without the express written consent of Inspira Travel Agency.
Severability

If conciliation fails, the parties agree to submit to the exclusive jurisdiction of the courts and tribunals of the city of Cancun, Quintana Roo, thereby waiving any other jurisdiction to which they may be entitled by reason of their present or future domicile, property location, or nationality, to the extent permitted by law. No complaints or claims related to the access or use of this Page may be brought more than one year after the date of such access or use.
